Chile has no license for online casinos or betting. Only physical casinos are authorized, and a bill to legalize and regulate online platforms is still moving through the Senate.

TL;DR

  1. Today: Online platforms operate outside the law. The Supreme Court said so on September 12, 2023 (case 152.138-2022), and the casino regulator has no powers over digital sites.
  2. Bill: Boletín 14.838-03, filed in 2022, passed the Chamber of Deputies on December 12, 2023 and passed the Senate in general. It is now in detailed review, with the government’s “suma urgencia” status since May 2026, and senators reported an agreed draft with the Executive in September 2026.
  3. Regulator: The Superintendencia de Casinos de Juego (SCJ) would become the Superintendencia de Casinos, Apuestas y Juegos de Azar.
  4. Tax: A 20% specific tax on gross revenue, on top of VAT, plus 2% of gross revenue for sport.

How the Chilean Bill Has Moved

  • 2022 – The government files the bill in the Chamber of Deputies.
  • September 2023 – The Supreme Court rules that unauthorized online gambling is unlawful and orders the blocking of platforms.
  • December 2023 – The Chamber approves the bill and sends it to the Senate.
  • August 2025 – The Senate approves it in general by 27 votes to 3, with 5 abstentions.
  • May–June 2026 – The government applies “suma urgencia”, and the Senate economy committee agrees a technical table with the Finance Ministry to settle open changes.
  • September 2026 – The committee reports a draft agreed with the Executive. Subtel, the telecom undersecretariat, confirmed 42 blocked gambling sites and 39 platforms registered for digital VAT, a mismatch senators called an inconsistency.

What Operators in Chile Would Face

The bill creates a semi-open market. iGaming operators must be closed corporations formed in Chile, and senators now also want a local office and registered address. Beneficial owners must be disclosed, liquidity reserves held, and technology certified. Platforms that operated illegally face a 12-month cooling-off period before they can apply for a substitute tax of 31% of gross revenue to regularize. Polla Chilena de Beneficencia would get an eight-year transition.

Bans on accounts for minors, verification of identification, deposit limits, and a national self-exclusion list applying to online gambling sites as well as casinos would become visible. The senators also suggest banning cash and material incentives to attract gamblers and prohibiting broadcasting of betting ads on radio and television at times not appropriate for minors. Tax revenue would fund community sport, problem gambling treatment, and the Common Municipal Fund. The SCJ, CMF, SII, and the financial intelligence unit UAF would gain powers to block sites and trace payments, backed by Chile’s economic crime law. SCJ counted over 900 unlicensed platforms in 2023.

Operators eyeing the market can prepare the product side in parallel. BSW’s custom platform bundles casino and sportsbook with local payments through the payment systems layer, and the API integration opens 10,000+ games. Licensing stays with the operator, and the neighboring Brazil and Paraguay pages show how other Latin American regimes treat the same questions.
